Valencia: Just Eat to omit hiring its delivery men by ETT in 2022

Just Eat has been recognised in a resolution issued by the Provincial Inspection of Labour and Social Security of Valencia that it has established “contracts in fraud of law through the temporary employment company JY Hiring” for its food delivery personnel, as per a press release of the CNT union. The union added that the lodged complaint is presently not merely obliged to include over 150 workers into its key staff but must do so until further notice.

The Just Eat Labour Resolution

The labour resolution precisely indicates that it is proved that the official availability contracts concerning the labours who have been delivering Just Eat’s food do not adhere to the assumptions permitted in Article 6.2 of Law 14/1994, of June 1st, which regulates temporary hiring agencies. The resolution states that the firm does not deal with temporary labour relations, which fulfil the provisions of Article 15.1 of the Workers’ Statute, but before a job of an unspecified nature.

The resolution indicated that Just Eat was requested on March 1st, 2022, to go forward with the direct and unspecified hiring of the labours who have been established within the positions of delivery men must proceed to do so before March 31st, 2022. Accordingly, just Eat moved to fulfil the requested necessity.

CNT València scrutinised the shakiness of this company and the exasperating factor of commissioning for their employment position. On the other hand, the union’s legal advisor, Antonio Ruiz, stated that the cooperation was portraying that its struggle was effective in honouring employment, and putting a close to mediators made it even riskier.

Alejandro Cantón Vitoria (rider from CNT València) stated that the union is affected by temporalty and uncertainty. The union has bifurcated schedules that do not allow it to amalgamate its work with anything else. As a result, the association goes throughout the week with several kilos stacked in a backpack on their backs. The agreement did not encompass conditions of weather either. Alejandro stated that their employment is tough to manage.

CNT València strives to set a standard to truly normalise the situation of people devoted to home delivery, owing to a recent regulatory change that tried to control the case of ‘false self-employment.’ However, this indicated the passage to commissioning via ETT. The resolution underscores a transformation towards inhibition in staff and for an uncertain duration.
